Under the federal law in Miami, the punishment for a conviction of mortgage fraud
can be up to 30 years in prison and a person can commit mortgage fraud by doing any
of the following:

– The person has an intent to defraud
– Using false identification to receive a mortgage
– Making material misstatement, misrepresentation, or omission during the mortgage lending process with the intention that will be relied upon by a mortgage lender, borrower, or any other person or entity involved
– Over-values any land or assets to obtain a mortgage
– Using or facilitating the use of any material misstatement, misrepresentation, or omission during the mortgage lending process
– Using a false Social Security number, name, or address to get a mortgage
– Receiving compensation connected with a material misstatement, misrepresentation, or omission during the mortgage lending process
– Using the mail or any wire service to aid in perpetrating mortgage fraud
– Being involved in the filing of a mortgage document that contains a material misstatement, misrepresentation, or omission.
